Terms of service.

These Terms of Service ("Terms") govern your access to and use of the apps, website, and services provided by 314stack ("314stack", "we", "us", or "our"), an independent developer. By downloading, installing, or using any of our apps or this website, you agree to these Terms. If you do not agree, please do not use the Services.

1. Eligibility and age

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Services. By using them, you represent that you meet this requirement. Our apps are not designed for children.

2. Accounts

Cadence does not require an account and has no sign-in or cloud backup — it works entirely on your device. Wayther requires an account; you may sign in with Google Sign-In or a verified phone number. Where you do create an account, you are responsible for:

• Keeping your sign-in credentials secure and not sharing them with others.
• All activity that occurs under your account, whether or not you authorised it.
• Notifying us promptly if you believe your account has been compromised, by emailing tech.314stack@gmail.com.

3. License to use the apps

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to download and use our apps on devices you own or control, for your own non-commercial use, unless otherwise agreed in writing. We retain all rights not expressly granted.

4. Acceptable use

You agree not to:

• Reverse engineer, decompile, or attempt to extract source code, except where applicable law expressly permits it.
• Use the Services to break any law or to infringe anyone's rights.
• Distribute malware, or interfere with or disrupt the Services or their security.
• Resell, sublicense, or commercially exploit the Services without our permission.

5. Cadence: productivity tool provided as is

Cadence is a focus and productivity timer. It is provided "as is" to help you track your focused time; it is not a professional, medical, or productivity-guarantee service. Your Cadence data lives on your device. Because Cadence has no account or cloud copy, uninstalling the app or clearing its data permanently deletes that data — please keep this in mind before uninstalling. We do not guarantee that the app will be uninterrupted, error-free, or available at all times.

6. In-app purchases and ads (Cadence)

The free version of Cadence is supported by ads (Google AdMob). Cadence offers Cadence Plus, a one-time in-app purchase that removes ads and unlocks additional features, sold and processed through Google Play Billing. Prices are shown in the app before purchase. Cadence Plus is a one-time unlock, not a subscription. Refunds are handled by Google Play under Google's refund policies; we do not separately process payments or store your payment details.

7. Wayther: forecasts and ETAs are estimates

Route forecasts, estimated arrival times, and pitstop suggestions provided by Wayther are generated from third-party weather and routing services and are estimates only. We do not guarantee their accuracy, completeness, or timeliness. Conditions change rapidly; always check official forecasts and exercise your own judgment when driving or travelling. Do not rely solely on Wayther for safety-critical travel decisions.

8. Your content

The focus sessions, categories, habits, and goals you create in Cadence, and the saved trips you create in Wayther, belong to you. You are responsible for the accuracy of the data you enter.

9. Third-party services

The Services rely on third parties, including Google (Firebase Authentication and Google Play for Wayther; Google AdMob, Google Play Billing, and Firebase Crashlytics and Analytics for Cadence) and weather and routing data providers (Wayther). Your use of those services is also subject to their respective terms and policies, and we are not responsible for their availability, accuracy, or conduct.

10. Intellectual property

The Services, including their design, code, branding, and the "314stack" name and logo, are owned by 314stack and protected by intellectual property laws. You may not use our branding without prior written permission.

11. Disclaimers of warranties

The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that route forecasts or ETAs will be accurate or delivered on time.

12. Limitation of liability

To the maximum extent permitted by applicable law, 314stack will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of or inability to use the Services, including but not limited to lost focus data in Cadence, or inaccurate forecasts or routing in Wayther. Where liability cannot be excluded, it is limited to the amount you paid us in the 12 months before the claim.

13. Termination

You may stop using the Services at any time by uninstalling the apps and deleting your account. We may suspend or terminate your access if you breach these Terms or where required to protect the Services or other users. Upon termination, you may request deletion of your account data via our Data Deletion page.

14. Changes to these Terms

We may update these Terms from time to time. We will revise the "Last updated" date above and, for material changes, provide a more prominent notice. Continued use after changes take effect constitutes acceptance of the revised Terms.

15. Governing law

These Terms are governed by the laws applicable at our principal place of business, without regard to conflict-of-law rules. Nothing in these Terms limits any non-waivable statutory rights you may have as a consumer under the laws of your country of residence.
